Governor Abbott Issues Statement On Texas’ Constitutional Right To Self-Defense

January 24, 2024 | Austin, Texas | Press Release

Governor Greg Abbott today issued a statement on Texas’ constitutional right to defend and protect itself as President Joe Biden continues to attack Texas and refuse to perform his duties to secure the border.

"The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now," reads the statement. "President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary."

empire stretching its resources thin fighting far off wars

local populace ravaged by disease and poverty

major province openly defying central government

yeah this is a certifiable sit-back-and-enjoy empire collapse moment

Eject Texas from the union the day before the election.
Dumb Texan yankoids go out to vote but there's pandemonium because they're not part of America and there are no Texan electoral college votes which would have otherwise fallen to Trump.
This causes genocide Joe to clearly win the election.
Demand that Texas rejoins the union the day after the election.
When they refuse, drone strike Abbott's house directly and the state capital as you control the empire security apparatus.

Do it you fucking coward

Genocide Joe will never use his machine gun hands for good, sorry Jack I don't make the rules

biden should declare war on and immediately surrender to mexico, ceding the previously annexed territory when there isn't an appropriate indigenous group to return it to.

[–] AnarchoAnarchist@hexbear.net 63 points 9 months ago (6 children)

As much as I like the idea, and the spirit of this comment, I don't know if it's fair to make Mexico take responsibility for a state as back ass-wards as Texas.

We've spent the better part of 200 years arming a bunch of white settlers while letting them circle jerk themselves raw over mythical Texan exceptionalism and Evangelical Christianity.

Giving Texas back to Mexico, is like feeding a toddler a pound of sugar, giving it a knife, and dropping it off at daycare.

[–] reverendz@hexbear.net 17 points 9 months ago

Also, the cartels are real shit.

Border towns are far more dangerous than 20 or 30 years ago.

Good friends of mine who grew up in El Paso, who have family on the Mexican side, avoid crossing over if they don't have to. Shit's gotten real.

The Mexican government is pretty much 3 cartels in a trench coat at this point.

This got an actual mirthful lol out of me

[–] CDommunist@hexbear.net 84 points 9 months ago (1 children)

For reference Article I, § 10, Clause 3 of the federal US constitution says:

No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.

So it looks the TX gov is trying to supercede federal policy on the border by claiming an invasion, empowering the state to do whatever it wants

[–] SacredExcrement@hexbear.net 36 points 9 months ago* (last edited 9 months ago)

So when Biden takes some action to resolve this, but in the process of so doing tacitly agrees with Abbott either by action or word, what then...

We really are going to end up invading Mexico, aren't we

And it'll be as a 'compromise'

[–] john_browns_beard@hexbear.net 73 points 9 months ago

Joe has a chance to do so many funny or cool things here and it's so upsetting knowing he will just choose to sit on his hands like every Democrat would in his position.

[–] cleoburymortimer@hexbear.net 71 points 9 months ago (1 children)

wtf does abbott actually want to achieve here, surely this is pre-election showboating and not a genuine attempt to split texas from the union?

[–] ElGosso@hexbear.net 72 points 9 months ago (1 children)

I think he's trying to put Biden in an unwinnable situation. Biden either backs down and looks like a wimp or rolls out the National Guard to pull down the wire and "let the migrants in."

[–] jack@hexbear.net 74 points 9 months ago (1 children)

A good politician would just arrest Abbott

[–] machiabelly@hexbear.net 15 points 9 months ago (2 children)

on what grounds? I'm not super up to date on this predicament

[–] axont@hexbear.net 55 points 9 months ago (2 children)

Deliberately defying federal court orders and then bragging about it.

Feds told Abbott to take down the razor wire. Abbott made the Texan Guard put it back up, then claimed Biden is violating the constitution. A stronger politician than Biden would arrest Abbott but nothing will happen because it's all theater anyway. Abbott doesn't truly give a shit and the razor wire is like 40 feet across a bridge that doesn't have migrant crossings anyway.

Literally all of this is theater. The chicken wire that the Texas guard put up isn't even at the locations where people are crossing the border. It's also like 40 feet of it. You can walk around it.

Abbott's an idiot. Texas would never be able to muster up a secession or even a federal court case.

[–] NephewAlphaBravo@hexbear.net 38 points 9 months ago

Biden could win this by posting a meme of Meal Team Six guarding a sandbox and giving no further context

[–] coeliacmccarthy@hexbear.net 31 points 9 months ago* (last edited 9 months ago) (1 children)

None of that matters. Who wins and who backs down doesn't matter and whether there's violence doesn't matter.

It's about the precedent and the demonstrated loss of legitimacy of the federal government. It's either civil war or the evaporation of the empire now, no more offramps

[–] axont@hexbear.net 31 points 9 months ago (1 children)

I lack the imagination necessary to guess what would be next. I agree with you that America ending is the only eventual conclusion. But I think the actors involved don't even know how to do it. None of these people know what genuine conflict is or how to do it. Their lives are built on comfort.

We're at the precipice and all actors involved are confused and comfortable. Abbott doesn't want a civil war. He's a millionaire. No elected official in America is prepared for a situation where they might reasonable be assassinated or their house burned down. None of them want a warzone in their front yard. They want to continue their happy little lives going to PF Chang's every Sunday and trips to Venice every year.

It's all theater until the moment they're ready to die.

The president has the legal authority to drone strike US citizens. Just saying. Is an AGM-114R9X soon heading Abbot's way?

Biden is making a mistake by not handling this aggressively. might makes right. People see power being exercised, and will naturally assume the person being targeted did something to deserve it. If they arrest him really gently, people will think they're spineless fascists. they're missing an opportunity if they don't do something dramatic with national guard helicopters landing on his lawn.

[–] Dr_Gabriel_Aby@hexbear.net 36 points 9 months ago

Legitimately would still be segregation in the south if the national guard didn’t role in

[–] invo_rt@hexbear.net 26 points 9 months ago (1 children)

Same shit as the Bundy ranch stand off thing a few years back. Chuds literally pointing guns at the feds and the feds backed down.

If it's an "invasion" doesn't that mean every migrant, legal or otherwise, is an enemy combatant? Does this fascist have the stomach to open concentration camps and execute people because they're brown and came through the border?

[–] Hello_Kitty_enjoyer@hexbear.net 17 points 9 months ago

If it's an "invasion" doesn't that mean every migrant, legal or otherwise, is an enemy combatant?

Yes, but we should start deporting the whites first

Mexico could take this as a declaration of war. This is serious and could have long lasting real consequences. I know its saber rartling but it's an attempt to compel the government to DMZ the border a la North South Korea.

No one in power or the media seems to be mature enough to discuss the real core reasons of the flood of migrants. Mainly blowback of our own overt and covert foriegn policy.

[–] Dessa@hexbear.net 13 points 9 months ago

Especially with state national guards potentially leaving home states. Remember the police couldn't keep control during the Floyd uprising
